These terms apply when your business uses Zawadi. By creating an account you agree to them. If anything here is unclear, email [email protected].
1. The service
Zawadi is software that lets a business ("you", the merchant) run a customer loyalty programme: points, rewards, stamp cards, referrals, vouchers and SMS messages to your customers. You use it through the Zawadi website and apps.
We may improve, change or remove features over time. If a change takes away something your plan depends on, we will tell you in advance.
2. Your account
You must give accurate business and contact details and keep your password and staff PINs private. You are responsible for what happens under your account, including actions by staff you add.
One person or business may not open accounts to get repeated free trials.
3. Free trials and billing
New accounts start with a free trial. The length depends on the plan and is shown on the pricing page when you sign up. No payment is taken during the trial.
Plans are billed monthly in Kenyan shillings and paid by M-Pesa from your dashboard. Prices are shown on our pricing page and may change; we will give you at least 30 days' notice of a price change for your plan.
If a payment is not made, your dashboard is paused until you pay. Fees already paid are not refunded, except where the law requires it.
4. SMS credits
Each plan includes SMS credits every month, and you can buy more for your SMS wallet. Every message Zawadi sends for your business, including points updates and campaigns, uses credits.
You may only send marketing messages to customers who have agreed to receive them, and you must honour opt-out requests. Messages must not be misleading, offensive or unlawful.
5. Customer data
The customer information you collect in Zawadi, such as names, phone numbers, visits and points, belongs to your business. You decide why it is collected, and you are responsible for having a lawful basis under the Kenya Data Protection Act, 2019.
We process that data on your behalf only to run the service, keep it secure, and do not sell it. Our privacy policy explains how we handle personal data.
If you close your account, you can ask us for an export of your customer data before it is deleted.
6. Acceptable use
Do not use Zawadi to send spam, run fraudulent points schemes, collect data without permission, attack or overload the service, or break any law.
We may suspend an account that puts customers, other merchants or the service at risk. Where we can, we will tell you why first.
7. Liability
We work to keep Zawadi available and accurate, but we provide it as it is. We are not responsible for losses caused by mobile network or SMS delivery failures, M-Pesa outages, or events outside our control.
To the extent the law allows, our total liability to you is limited to the fees you paid us in the three months before the claim.
8. Ending the agreement
You can stop using Zawadi at any time; there is no contract period. We may end the agreement if you seriously or repeatedly break these terms.
9. Governing law
These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute.
